​CLIENT SERVICES AGREEMENT

PARTIES, DEFINITIONS, LOCATIONS AND SCOPE
In this Agreement, “Client,” “I,” “me,” and “my” mean the person signing below. “Port Rover” means Port Rover, LLC and, where applicable, its owners, officers, employees, agents, and authorized contractors acting within the scope of their work for Port Rover. “Pet” means each dog identified in my Port Rover account or below.
This Agreement applies to services provided at either Port Rover location listed above and, when applicable, at other locations while my pet is under Port Rover’s care. Covered services may include facility tours, events, open play, daycare, day school, adventure or enrichment programs, overnight boarding, grooming, training, in-home care, temperament or boarding evaluations, transportation, walks, and other services I request or authorize.
This Agreement binds me and, to the extent permitted by law, my estate, personal representatives, heirs, successors, and assigns. It does not treat another adult as having signed this Agreement merely because that person is related to or associated with me.

SERVICES, ELIGIBILITY AND PARTICIPATION
Registration does not guarantee acceptance for any service. Port Rover may require an evaluation and may refuse, limit, modify, suspend, or discontinue services when Port Rover reasonably believes doing so is necessary for safety, health, staffing, operational, or behavioral reasons. Reasons may include aggression, unsafe handling, excessive distress or barking, escape behavior, illness, parasites, poor physical condition, incomplete records, or failure to comply with Port Rover policies.
I understand that placement in group play is not guaranteed. Port Rover may use individual care, rest periods, separation, crates or kennels, leashes, barriers, safety equipment, or other reasonable handling measures. When reasonably necessary for immediate safety, Port Rover may use a properly fitted muzzle or discontinue the activity. Port Rover will not administer sedatives unless supplied and authorized by me in accordance with Port Rover’s medication policy or directed by a veterinarian.

ASSUMPTION OF RISK AND RELEASE
I understand that entering an animal-care facility and participating in pet-care services involve inherent risks to people, animals, and property. These risks include bites, scratches, falls, collisions, escape, property damage, exposure to illness or contagious disease, allergic reactions, stress, and injuries resulting from interactions with animals or the unpredictable behavior of animals.
I voluntarily accept these inherent risks for myself and my pet. To the fullest extent permitted by Virginia law, I release Port Rover from claims arising from inherent risks or ordinary negligence associated with the services provided. This release does not apply to gross negligence, willful misconduct, intentional acts, or any duty or responsibility that cannot legally be waived. Nothing in this Agreement limits any right or remedy that applicable law does not permit the parties to waive.
I understand that Virginia law may restrict the enforceability of a pre-injury release involving bodily injury to a person. This section is intended, at minimum, to document my knowledge and voluntary acceptance of the inherent risks described above and will be enforced only to the extent permitted by law.

LEGAL OWNERSHIP, RECORDS, AND CLIENT DISCLOSURES
I certify and agree that:
I am the legal owner of my pet or have full legal authority to make decisions and enter into this Agreement for the pet.

  • ​My pet is currently and properly licensed and vaccinated as required by law and Port Rover policy, and I have provided accurate proof of required vaccinations.
  • To my knowledge, my pet has not been exposed within the past 30 days to rabies, parvovirus, distemper, canine influenza, canine cough, or another contagious disease, except as specifically disclosed to Port Rover.
  • ​I have disclosed all known medical conditions, medications, allergies, injuries, physical limitations, contagious conditions, escape tendencies, resource guarding, reactivity, aggression, and bite history involving people or animals.
  • I will promptly update Port Rover whenever this information changes.
I understand that Port Rover relies on the accuracy and completeness of my disclosures when deciding whether and how to provide care.

RESPONSIBILITY FOR MY PET AND THIRD PARTY CLAIMS
To the extent permitted by law, I am responsible for injury or property damage caused by my pet and for reasonable costs resulting from information that I knowingly or negligently failed to disclose. I will cooperate in resolving any incident involving my pet.
To the extent permitted by law, I agree to indemnify Port Rover against third-party claims, losses, or reasonable expenses arising from (a) my pet’s actions, (b) materially inaccurate or omitted information I provided, or (c) the acts or omissions of a person I authorized to drop off or pick up my pet, except to the extent the claim was caused by Port Rover’s negligence, gross negligence, willful misconduct, intentional act, or non-waivable legal duty. This provision does not prevent an injured third party from pursuing any claim available under law.

EMERGENCY VETERINARY AUTHORIZATION AND EXPENSES
I authorize Port Rover to provide reasonable first aid and obtain emergency veterinary treatment if my pet becomes ill or injured while in Port Rover’s care. Port Rover will make a reasonable attempt to contact me and my emergency contact before incurring veterinary expenses when circumstances permit. I understand that treatment may be obtained before contact when delay could cause additional suffering, illness, injury, or risk.
If my preferred veterinarian is unavailable or circumstances require faster care, Port Rover may select another licensed veterinarian or emergency veterinary facility and may transport my pet for treatment. I authorize the veterinarian to examine, stabilize, and treat my pet as reasonably necessary.
Responsibility for veterinary expenses will be determined under applicable Virginia law. I am generally responsible for reasonable and necessary emergency veterinary expenses for illness or injury occurring while my pet is in Port Rover’s custody. Port Rover will be responsible for expenses when and to the extent Virginia law places that responsibility on Port Rover, including qualifying injuries resulting from Port Rover’s failure to provide legally required care or from Port Rover’s actions. I authorize Port Rover to charge amounts properly owed by me to the payment method on file.

VIRGINIA BOARDING ESTABLISHMENT NOTICE
NOTICE: The boarding of animals is subject to Article 4 (§ 3.2-6518 et seq.) of Chapter 65 of Title 3.2. If your animal becomes ill or injured while in the custody of the boarding establishment, the boarding establishment shall provide the animal with emergency veterinary treatment for the illness or injury.
The consumer shall bear the reasonable and necessary costs of emergency veterinary treatment for any illness or injury occurring while the animal is in the custody of the boarding establishment. The boarding establishment shall bear the expenses of veterinary treatment for any injury the animal sustains while at the boarding establishment if the injury resulted from the establishment's failure, whether accidental or intentional, to provide the care required by § 3.2-6503. Boarding establishments shall not be required to bear the cost of veterinary treatment for injuries resulting from the animal's self-mutilation.


CONTAGIOUS DISEASES, PARASITES, AND CANINE BLOAT
Port Rover uses reasonable cleaning, sanitation, monitoring, and isolation practices to reduce health risks. Nevertheless, no communal animal-care environment can eliminate the risk of exposure to canine cough (Bordetella), canine influenza, parvovirus, distemper, parasites, or other contagious conditions. Vaccination reduces certain risks but does not guarantee immunity.
If my pet shows signs of a contagious condition or is found to have fleas, ticks, worms, or other parasites, Port Rover may isolate the pet, discontinue services, request immediate pickup, and require veterinary clearance before the pet returns. I am responsible for authorized or reasonably necessary treatment, additional cleaning, isolation, and handling charges except when applicable law provides otherwise.
To reduce the risk of gastric dilatation-volvulus, commonly called canine bloat, Port Rover generally provides at least one hour of kennel or quiet rest after a meal before active play. I will tell staff if my dog ate within one hour before arrival. I understand that rest periods do not eliminate the risk of bloat and that I should consult my veterinarian about my dog’s individual risk factors.

GROOMING AUTHORIZATION (IF APPLICABLE)

Health, Behavior, and Service Limits
When I request grooming, bathing, brushing, nail trimming, ear cleaning, de-shedding, hair removal, or another grooming-related service, I authorize Port Rover to perform the requested service using reasonable professional judgment. I confirm that I have disclosed all conditions that could affect grooming, including allergies, sensitivities, medications, recent surgeries, seizures, heart or respiratory conditions, skin or ear conditions, injuries, behavioral concerns, and bite history.
Grooming may expose or aggravate conditions that were previously hidden, including irritation, sores, hot spots, growths, parasites, infections, bruising, or other medical concerns. Port Rover may notify me of observed concerns but does not diagnose medical conditions or provide veterinary treatment.

Matting and Coat Condition
I understand that removing a tangled or matted coat may require shaving or clipping the coat shorter than requested. Mat removal can reveal or contribute to redness, irritation, bruising, abrasions, hematomas, or other conditions caused or concealed by matting. I authorize Port Rover to shave or shorten the coat when reasonably necessary for safety and comfort. Port Rover may stop the service if mat removal cannot be completed safely or humanely.
Additional fees may apply for excessive matting, extra handling time, parasites, heavily soiled coats, or special coat conditions. Port Rover cannot guarantee a particular appearance or an even coat when coat condition, behavior, health, safety, or the pet’s tolerance limits available grooming options.

Senior Pets, Safety Measures, Nails, and Ears
Grooming may be physically or emotionally stressful, especially for senior pets, puppies, anxious pets, and pets with medical conditions. I authorize reasonable safety measures, which may include additional staff assistance, safety restraints, protective equipment, a properly fitted muzzle, rest breaks, service modification, or discontinuation. I remain responsible for work completed and reasonable handling fees incurred before a service is stopped.  I understand that nail trimming can result in accidental bleeding, especially when nails are dark, overgrown, brittle, or difficult to trim. Ear cleaning may reveal or irritate an existing infection, sensitivity, or injury. Closely clipped areas may experience temporary redness or irritation. Port Rover will use reasonable care but cannot guarantee these reactions will not occur.

Grooming Concerns
Port Rover will make reasonable efforts to follow my instructions. I agree to report concerns about the grooming result within 48 hours. Port Rover may offer a reasonable adjustment when appropriate but cannot guarantee a particular style or appearance. Emergency care and expense responsibility remain governed by Sections 6 and 7 of this Agreement.

AUTHORIZED DROP OFF AND PICKUP PERSONS
I may designate one or more adults to drop off or pick up my pet. Each designated person has my permission to receive information reasonably necessary for the handoff and to take custody of my pet. I represent that each person I designate is physically capable of handling the pet safely.
Port Rover may rely on my approved-person list until I provide written notice changing it. Port Rover may require government-issued photo identification and may refuse or delay release when identity, authorization, equipment, behavior, or the safety of the handoff cannot be reasonably verified.
I am responsible for informing each authorized person about my pet’s behavior, handling needs, medical conditions, equipment requirements, bite history, and escape tendencies. Port Rover may require an authorized person to follow safety instructions and sign a separate acknowledgment of risk before entering restricted areas or handling the pet. Minors may not take custody of a pet unless Port Rover gives prior written approval and a parent or legal guardian is present.

CUSTOMER CONCERNS AND RESOLUTION
Port Rover strives to provide safe, professional, and compassionate care. If I have a concern regarding my pet’s care or experience, I am encouraged to contact Port Rover promptly so management has an opportunity to review the matter and work toward an appropriate resolution.  Nothing in this Agreement prevents me from making an honest statement, submitting a lawful complaint, contacting a government agency, cooperating with an investigation, or exercising any right protected by law.

POLICIES, PRICING, RESERVATIONS AND PICKUPS
Current operational policies and pricing may be posted at www.portrover.com or provided through Port Rover’s reservation system. These may include lobby safety, hours, deposits, payment requirements, late fees, reservation changes, cancellations, missed appointments, medication handling, feeding, pickup, and personal-property policies.
I agree to follow policies in effect when I request or receive a service. Port Rover may reasonably update operational policies and prices and will provide notice of material changes by email, website posting, account notice, or another reasonable method. A website update will not, by itself, materially expand this Agreement’s release, indemnification, or dispute terms without additional consent when required by law. I am responsible for keeping my contact information current.
I will pick up my pet by the agreed time or arrange an authorized alternative. I am responsible for applicable late, extended-care, transportation, and other charges. If a pet remains unclaimed, Port Rover may take actions permitted by Virginia law after providing required notice. Nothing in this paragraph permits abandonment of an animal.

PRIVACY AND SMS COMMUNICATIONS
Port Rover may collect contact, account, pet-care, reservation, payment, and communication information that I provide through its website, Gingr account, email, telephone, forms, or third-party reservation and payment systems. Port Rover uses this information to provide services, manage reservations, communicate with clients, maintain records, process payments, improve operations, and comply with legal obligations.
Port Rover does not sell or rent mobile telephone numbers or share them with third parties for their own marketing purposes. Port Rover may provide information to service providers that assist with reservations, payments, communications, technology, veterinary care, or other business operations, subject to appropriate use and security restrictions. Information may also be disclosed when authorized by me or required by law.
Information is retained for as long as reasonably necessary for the purposes described above, to meet recordkeeping obligations, or to resolve disputes. I may contact Port Rover at [email protected] or (757) 657-8060 to request correction or deletion, subject to legal and legitimate business-retention requirements.

TERMS, ELECTRONIC SIGNATURES, AND GENERAL TERMS
This Agreement begins when signed and applies to my pet’s current and future visits until replaced or terminated in writing. Revocation does not affect services already performed, amounts already owed, or rights and responsibilities arising before Port Rover receives the revocation.
Electronic signatures, checkboxes, and acknowledgments have the same effect as handwritten signatures to the extent permitted by law. If any provision is found unenforceable, the remaining provisions will continue to the fullest extent permitted by law. This Agreement is governed by Virginia law. No oral statement changes this Agreement unless confirmed in writing by an authorized Port Rover representative.

CLIENT ACKNOWLEDGMENT AND SIGNATURE
By signing, I confirm that I have read and understood this Agreement, had an opportunity to ask questions, provided complete and accurate information, and voluntarily agree to its terms. I understand that this Agreement contains risk acknowledgments, authorizations, financial responsibilities, and limitations that may affect legal rights.
